Terms and Conditions

Effective from 1 September 2025.

General Provisions

  1. The online store aquabara.com is operated by HAIAP Sp. z o.o. with its registered office at Nosówek 27A, 78-200 Białogard, Poland, registered in the National Court Register by the District Court in Koszalin, IX Economic Division, under KRS number 0000642092, NIP: 6722084759, REGON: 365633455. Share capital: PLN 30,000.00 (fully paid).
  2. These regulations define the rules for using the online store, placing orders, and executing sales.
  3. The store sells exclusively to entities conducting business or professional activities and to public institutions.
  4. Natural persons making purchases for private purposes, not directly related to business or professional activity, are not entitled to use the store's offer.

Registration and Placing Orders

  1. Placing an order requires providing full identification data of the company or institution, including the tax identification number.
  2. By placing an order, the Client declares that the purchase is made in connection with their business or professional activity and is not of a consumer nature.
  3. The Seller reserves the right to verify the provided data and to refuse to process an order if it is found that the Client does not meet the conditions specified in these regulations.
  4. The sales agreement is concluded upon the Seller's confirmation of the order acceptance.

Prices and Payments

  1. All prices in the store are net prices and do not include VAT or other additional fees, such as customs duties or import taxes.
  2. Upon request, we provide a detailed breakdown of the total order cost, including VAT, customs duties, and other import fees.
  3. Delivery can be arranged under Incoterms DDP (Delivered Duty Paid), which means that all transport costs, customs duties, and taxes are covered by the Seller until the goods are delivered to the specified address.
  4. Payment methods:
    1. prepayment by bank transfer, SEPA and SWIFT transfers are accepted,
    2. deferred payment,
    3. payment by Visa, MasterCard credit/debit cards,
    4. international money transfers such as WesternUnion, MoneyGram,
    5. other methods indicated during the order process.
  5. The payment term is determined individually, and in the case of prepayment, the order is processed after the funds are credited.

Delivery

  1. Goods are delivered to all countries, except for countries and regions subject to sanctions, embargoes, or other restrictions under Polish law, European Union law, or international agreements. In the case of an order from such regions, the Seller reserves the right to cancel the order and refund the payment.
  2. Transport costs and delivery times are indicated when placing the order.

Complaints and Warranties

  1. The Client has the right to file a complaint regarding goods that are not in conformity with the contract.
  2. Complaints should be submitted in writing or electronically to the address indicated on the store's website.
  3. Complaints are processed within 14 days of their receipt.
  4. The Seller's liability is limited to the value of the ordered goods.
  5. The Seller may provide a warranty on the offered goods if it is explicitly stated with the product.

Exclusion of Consumer Regulations

  1. By placing an order, the Client confirms that the purchase is made in connection with their business or professional activity, and the purchased goods will be used exclusively for professional purposes.
  2. The store sells exclusively to businesses and institutions. The Seller does not sell to consumers or individuals making purchases for purposes not directly related to their professional or business activity.
  3. The provisions concerning consumer protection, in particular the right to withdraw from the contract and the information obligations characteristic of consumer sales, do not apply to contracts concluded through the store.
  4. The parties confirm that all agreements are of a professional nature (B2B).

Final Provisions

  1. In matters not regulated by these Regulations, Polish law shall apply.
  2. Any disputes arising from contracts concluded through the store will be resolved by the court competent for the Seller's registered office.
  3. The Regulations are effective from the date of their publication on the store's website.
